Go Morzine Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of our mobile application, website, and services, including ride-hailing, food delivery, shopping delivery, payment processing, and related features (collectively, the "Services"). By accessing or using our Services, you agree to these Terms. If you do not agree, please discontinue use immediately.

Go Morzine ("the company," "we," "us," "our,") is part of PSB Projects SAS of 1673 Route De La Plagne, 74110 Morzine and is a transport company offering passenger and freight transport services.

The customer ("the user," "the client," "you," "your,") describes any person using the Go Morzine website or app.

1. Eligibility

To use the Services, you must:

  • Be at least 18 years old.
  • Have the authority and ability to enter into a binding contract.
  • We may require identity verification and may deny access if information is inaccurate or incomplete.
  • We may require proof of age for access to services.

2. Account Registration

You must create an account to access the Services. You agree to:

  • Provide accurate, complete information.
  • Keep your login credentials confidential.
  • Notify us immediately of unauthorized access.

You are responsible for all activity under your account.

3. Description of Services

3.1 Ride

The term ride ("lift," "cab," "transport service") refers to transport services offered by Go Morzine. These services are delivered in vehicles operated by Go Morzine, or trusted and verified partner transport operators.

3.2 Food & Shopping Delivery

We facilitate the ordering of food and retail items from local merchants and handle the delivery element of this service. We do not prepare food, manufacture products, retail products or guarantee availability or quality of any products offered by third party merchants via Go Morzine.

4. Reservations and Payments

  • When you reserve a service with Go Morzine you are entering a contract with the company.
  • There may be times when your services are delivered by a third party transport suppliers.
  • Prices shown in the app include service fees, delivery fees, tolls, and other applicable charges.
  • You authorize us to charge your selected payment method for all transactions. All our transactions are carried out using Stripe secure processing.
  • All payments are final and non-refundable except as required by law or stated in our refund policy.
  • Surge pricing or dynamic pricing may apply.

5. User Conduct

You agree not to:

  • Use the Services for unlawful purposes.
  • Harm or threaten drivers or merchants.
  • Damage property or behave disorderly during a ride or delivery.
  • Use automated tools, bots, or attempt to disrupt our systems in any way.

We may suspend or terminate your account for violations.

6. Cancellation Policy

Cancellation fees may apply for:

  • Cancelling a ride after a driver is assigned.
  • Cancelling a delivery after it has been prepared or purchased.
  • Cancellation fees are detailed in the app at the time.

We reserve the right to charge full or partial order value for cancellations.

7. Delivery Terms

  • Ride times and delivery times are estimates and not guaranteed.
  • You must provide accurate delivery information including contact information and addresses.
  • If you are unreachable at the ride collection time and location, we will wait for 5 minutes. If you do not respond then the driver will be free to move on and payment will be taken.
  • If you are unreachable at delivery, the delivery person will try to contact you and will wait 5 minutes. If contact remains impossible the order may be left at the location, returned, or canceled, payment will be taken for services.

8. User Content

  • You may submit content such as reviews or feedback. You grant us a worldwide, royalty-free license to use, display, and distribute such content.
  • You agree not to submit unlawful, defamatory, or misleading content.

9. Intellectual Property

All trademarks, logos, software, and content on the platform belong to Go Morzine or its licensors. You may not copy, distribute, or modify them without permission.

10. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share your information.

11. Third-Party Links

The app may contain links to third-party websites. We are not responsible for the content or policies of those sites.

12. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, including:

  • Accuracy,
  • Reliability,
  • Availability,
  • Suitability for a particular purpose.

We do not guarantee uninterrupted access or error-free operation.

13. Limitation of Liability

To the maximum extent permitted by law, Go Morzine is not liable for:

  • Personal injury,
  • Property damage,
  • Lost profits,
  • Delays or service outages,
  • Conduct of sub contracted drivers, third party merchants, or other users.

Our total liability will not exceed the amount you paid for the service giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Go Morzine, its affiliates, employees, and partners from any claims arising from your use of the Services, violation of these Terms, or interactions with Drivers/Merchants.

15. Termination

We may suspend or terminate your account at any time for behavior that violates these Terms or for misuse of the platform.

You may stop using the Services at any time.

16. Governing Law

These Terms are governed by the laws of France, without regard to its conflict-of-laws principles.

17. Dispute Resolution

Any disputes shall be resolved through:

  • Negotiation,
  • Mediation,
  • Binding arbitration (if applicable under local law).

18. Changes to Terms

We may update these Terms periodically. Changes become effective upon posting. Continued use of the Services constitutes acceptance of revised Terms.
